Targets and objectives.

 

The auction house "GLOBUS" was established to grant state, municipal, regional and other customers an opportunity of effective usage of property and asset, and also for attraction and location of investments in various fields of activity with application of competitive trade form.

The auction house "GLOBUS" has been established to realize the following targets and objectives:

• organizing and carrying out auctions on sale of movable and immovable, mortgaging, confiscated, arrested property and property in abeyance, securities, antiques, works of art, vehicles, ground areas, etc.;
• organizing and carrying out tenders and competitions on purchase of machines, mechanisms, techniques and technology, industrial, agricultural and other goods for state needs, and also on attraction and location of Russian and foreign investments;
• arranging orders for construction, contract, operational, other works and services on competitive basis.
• rendering consulting, representative, intermediary, marketing, advertising, information and other services.

Auction house "GLOBUS" provides preliminary and specialized expert examination, studying and forecasting of market, guarantees legal capacity and solvency of parties to joint transaction. Auction house "GLOBUS" successfully and fruitfully cooperates with number of independent research and expert establishments. Public biddings are a unique market mechanism which allows, according to current legislation, to define suppliers of goods, jobs and services, to establish market cost of immovable, mortgaging, confiscated property and property in abeyance, market cost of actions and other securities, to secure involvement and location of investments, to raise their efficiency, to save budgetary funds, to support manufacturers and suppliers of domestic production publicly and on competitive basis.

Auction house "GLOBUS" invites various Russian and foreign organizations, companies and firms to cooperate in following activities:

• organizing and carrying out transactions with movable property and real estate, auctions, competitions, tenders in market of antiques, works of art and different art values; confiscated, arrested, ownerless and other property, industrial and agricultural goods, ground areas, securities, intellectual and other property;
• arranging of state, regional, municipal and other orders on involvement and location of investments in various fields of activity, on delivery and purchase of foodstuffs, consumer goods, techniques, technologies, medicines, on works and services in sphere of city municipal services, social and other programs-on competitive basis ;
• rendering consulting, representative, intermediary, marketing, advertising, information and other services.

Bidding regulations.

General provisions

Auction bidding is carried out by organizer of auction (further -organizer)in purpose to sale to participants of auction (further - participants) lots exposed on bidding on basis of present Regulations.

Organizer arranges expert examination to establish authenticity and authorship of subjects.

Organizer provides all persons, who would like to take part in auction, opportunity to familiarize with lots, exposed on bidding, during pre-auction exhibition or directly before beginning of auction.

If participants of auction had not time to familiarize sufficiently with subjects of auction bidding before the beginning of auction , they cannot make a complaints or objections during biddings or at payment of bought lots.

Prices on exposed lots are specified in rubles. All calculations are made in Russian rubles at rate of the Central Bank of Russian Federation at date of calculation.

 

Organizers and participants of auction.

During biddings organizer operates through auctioneer and secretary, in other time - through the lawful representatives.

As buyers in auction can participate:

• any completely capable physical persons who have reached eighteen-year age.
• any legal persons, which representatives before beginning of bidding should hand over to organizer’s representative the power of attorney on right of participation in auction and letter of guarantee with obligation to pay bought lots. In case if purchase is not accomplished, these documents return to participant.
• Official representative of the purchasing commission of auction house.

Condition of registration as the buyer is reception of bidding participant number card.

If person, who would like to get any lots, has no opportunity or desire to participate in bidding personally, he can leave the assignment (bid in absentia) to organizers of auction, having specified numbers of lots and ceiling prices for them.

Organizer undertakes to purchase specified lots on minimum price, taking into account other assignments and internal bidding in auction hall. Given service is confidential and free-of-charge.

If ceiling prices on same subject, specified in two and more bids in absentia, will match, advantage gets the person, whose assignment was given earlier.

If participant of auction who has bought one or several lots, does not pay by cash right after the end of bidding, he can leave to organizer pledge at rate of 30 % from general reached cost of bought lots and to pay purchase in full within three days.

If after three days bought lots are not paid in full, the mortgaging sum will not be given back and lots enter into disposition of organizer. In default from purchase of lots up to expiration of three days, sum at rate of 30 % from paid-in pledge is given back to participant.

Number card of participant is the unique certificate confirming right of participation in bidding. If participant allows third party to possess the card, he bears responsibility for its actions as for his own.

 

Adjudication.

As time of bidding is considered the time from exposition on auction of first lot till sale or removal from bidding of last lot. Bidding is conducted in sequence order of numbers.

Bidding is conducted by auctioneer. During bidding he is the unique representative of organizer. All disputes and disagreements which have arisen during tenders are solved by auctioneer. His decision is final.

Organizer has right to remove from auction up to beginning of bidding any lot without explaining the reasons.

Raising of number card means absolute and irrevocable consent of participant to buy exposed on bidding lot under declared price. Every subsequent raising of cards by participants means consent to get lot under the price exceeding last declared price on one step.

If auctioneer does not declare other, step, on which the lot price increases during bidding, is approximately 10 %. Auctioneer have the right to establish during bidding other step, having declared about it to participants of auction.

Participant can propose during bidding to buy the lot under any price exceeding previous offer more than on one step. In this case further counting is conducted from the price offered by participant.

With fall of the hammer participant, whom auctioneer has defined as last person who rose number card, becomes proprietor of given lot. Since this moment transaction on sale and purchase is considered as accomplished, refusal from it or making any additional terms and objections are impossible.

If on trading lot any number card was not risen, it is removed from biddings and can be sold in order of post-auction sales.

In a hall where biddings are carried out, any sort of advertising actions, photo and filming, audio and video recording, and also other actions which are aimed at subsequent audio or visual reproduction of event in auction hall is not allowed without preliminary sanction of the organizer. Persons making specified actions, are turned out from hall and lose the right of further visiting of auctions; material data carriers are withdrawn without cost compensation.

 

Guarantees.

Safety and confidentiality guarantees

Security service of Auction house "GLOBUS" has all necessary licenses and hardware, and carries out protection of premises and events.

Information on clients names and location, and also about sums of transactions is a trade secret and its observance is strictly controlled.

Influence of present guarantees distributes only to the buyer - continuous proprietor who has received from the Auction house "GLOBUS" corresponding documents on the right of item possession. This item should be free from any property obligations and owner is obliged to confirm it.

Payment

The size of payment

For items purchased on collection auction, it is a commission in addition to sale price established in size:

• 5 % if cost of purchased lot makes $100000 and more;
• 10 %, if cost of purchased lot from $25000 up to $100000;
• 15 %, if cost of purchased lot less than $25000.

Way of payment

Purchased items may be paid in any convenient way.

In cash: money are brought in cash register at fulfillment of purchase, all at once or in few stages.

By bank transfer: at presence of bank guarantee.

 

Payment order

If it is more convenient for you to pay purchase stage by stage, you can leave deposit for the items you have chosen at the rate of 30 % from their cost. You keep the right to redeem these items within three calendar days from day following after the day of purchase. At non-cash form of payment we should get the copy of payment order which have been lead by bank, not later than three working days from date of auction.

If you for any reasons refuse to redeem these items, they enter in free sale again. Thus you get back 30 % from the sum of a pledge that you have paid, in case if you have informed about such decision before expiration of three calendar days from the moment of purchase.

You should follow same rules at payment of lots, bought by phone and under in absentia guarantee.

 

Export of purchased personal estate items.

Purchased and completely paid by you items can be taken out within five calendar days from the moment of purchase. For each next day of storage you will have to pay at rate of 0.5 % from cost of purchases for a day.

• registration and re-registration of commercial and noncommercial legal persons

• representation in courts

 

Lawyers of Auction house "GLOBUS" work in close cooperation with all units of the company and render all necessary legal support in questions concerning real estate. Examination of property on legal "purity" is carried out in strict conformity with legislative certificates of Russian Federation and government of Moscow, and guarantees the future property owner full safety of committing sale and purchase transactions at secondary market.
